What is an AFSS?

Under NSW law, building owners are required to provide an Annual Fire Safety Statement (AFSS) to their local Council. The AFSS details a comprehensive list of site-specific Essential Fire Safety Measures (EFSM) and confirms the fire protection systems are up to Australian Standards.

Building owners will receive notice from the Council when their Annual Fire Safety Statement is due to be submitted, as well as a copy of the Fire Safety Schedule (FSS), which details all the EFSM’s that are required to be installed and compliant on the property.

To provide a valid AFSS, an Accredited Practitioner in Fire Safety (APFS) is required to inspect, test and endorse every Measure listed on the Schedule which will be provided to the building owner from their local Council. This inspection must take place within 3 months of the due date.

Understanding Fire Safety Assessment

Since July 1, 2020, the NSW Environmental Planning and Assessment Regulation 2000 requires building owners to have all fire safety measures assessed and endorsed by an Accredited Practitioner Fire Safety. After the assessment, the Annual Fire Safety Statement (AFSS) or Fire Safety Certificate must be submitted to both the local Council and NSW Fire & Rescue. A copy must also be displayed prominently in the building.

The Fire Safety Certificate and Annual Fire Safety Statement are endorsed by an Accredited Practitioner Fire Safety, but the building owner or their designated agent is ultimately responsible for the final sign-off.
An AFSS must be submitted every year, starting from the date the first Fire Safety Certificate was issued. If the AFSS hasn’t been submitted to the Council in the past 12 months, it’s overdue and must be submitted immediately to avoid fines or legal consequences.
A Fire Safety Certificate is required before any new construction or major building alterations. This certificate lists all fire safety measures for the property. After being reviewed by a registered fire safety professional, it is submitted to the local council for approval.
An FSS is a detailed list of required fire protection systems and equipment for a property, along with the standards each measure must meet. It includes relevant building codes, Australian Standards, and other compliance requirements.
The AFSS requires an accredited individual to assess, test, and service all items listed on your FSS. Council inspections may lead to the issuance of an FSS, and if they have the relevant data, they can provide it upon request. Accredited assessors, including fire protection professionals, are authorized to issue Fire Safety Schedules.
